Well, I'm not entirely sure, and I'm too lazy to go to the Secretary of State's office to look to see what treaties are still in force. However, I can take a guess-which would be yes, it would be allowed. Reason being, existing contracts and treaties give the various Indian nations sovereignty. So, is herb was a traditional ritual, then it would be allowed.
