I think she's very..... crazy in a somewhat negative way. <.< I ain't paying taxes yet till after my birthday this year. It's not fair we have to contribute money to crazy lady.

Is it legal to take her kids from her at the moment? Or to take/have taken her utirus out?

The answer is no for both questions. You can't take her kids away because I'm pretty sure that she has money (I mean she has her own publicist) and you would need to show causation. And you can't take away her uterus out because it's unconstitutional. There are 2 major cases that dealt with reproduction and that is Buck v. Bell and Skinner v. Oklahoma. In Buck, the Court upheld a state law sterilizing mentally retarded people "for the protection and health of the state." Skinner v. Oklahoma was the same thing, but instead of mentally retarded it was for anyone who was a criminal. But in Skinner, the Court said that compulsory sterilization as a punishment for a crime when applied only to certain categories of crimes violates the Equal Protection Clause. If her uterus were to become a legal issue under the Equal Protections Clause, then the State would have too pass a scrutiny test. I'd guess that it'd be middle-tier scrutiny in which the government must show that the challenged classification serves an important state interest and that the classification is at least substantially related to serving that interest. The State cant make a law saying "The State will take Octo mom's uterus out" because that'll be a Bill of Attainder which is unconstitutional. They also can't make a law now to do something about it because that'd be Ex Post Faco (also unconstitutional). And taxpayers can't bring suit against her (I don't think) because taxpayer standing in Court has never really worked out (seemingly only in Flast v. Cohen).

It's not a mistake though. If she wants to pop out enough kids to populate a planet, then let her. Some people (like my Aunt) love being a mother. At least this woman isn't shooting up drugs, or something else. Her kids (I don't hear anyway) seem to be trouble makers. As long as they stay in school and not end up as an ill of society, then I can be happy with that. But if she things her kids are nothing but meal tickets and a stairway to the limelight, then she has another thing coming. The funny thing is we pay welfare for tons of things, so if she decides to go on welfare, why should everyone else be mad?
